By placing an order in the BeachDash app, you acknowledge that you have read, understood, and agree to these Terms and the Liability Waiver.

Welcome to BeachDash! These Terms of Service & Waiver ("Terms") govern your use of the BeachDash mobile application and website (collectively, the "Service").
1. Key Definitions
The BeachDash platform, including our app and website, used to process on-demand rentals.
Any and all gear rented through our Service, such as chairs, umbrellas, and coolers.
A request placed through the Service for the rental of Equipment.
The time from when Equipment is delivered to you until it is returned to us.
The meetup spot where you receive Equipment from our team.
When you request return and meet our team to hand back the Equipment.
2. Your Responsibilities
- You must be at least 18 years of age to place an Order.
- You are responsible for the proper use and care of all rented Equipment during your Rental Period.
- You agree to pay for any damages beyond normal wear and tear, which may include repair or full replacement fees.
- You agree to comply with all local beach regulations and laws while using the Equipment.
3. Delivery & Pickup Handoff
BeachDash provides a curbside-style handoff service. Our responsibility is to deliver the Equipment to you at the agreed-upon Drop-off location and retrieve it at the agreed-upon Pick-up location.
- You must be present for both Drop-off and Pick-up.
- Failure to be present may result in your Order being cancelled without a refund and/or additional fees.
- We do not provide setup, supervision, or any other services on the beach.
- We encourage you to inspect all Equipment upon delivery and report any issues to our team immediately.
4. Payments & Cancellations
- All rental fees and charges are processed securely via our trusted payment partner, Stripe.
- You may cancel your Order while it is still pending or just accepted by a driver.
- Once a driver is en route to you, cancellations require contacting support and may result in a partial or full charge.
Important: Assumption of Risk & Liability Waiver
Your safety is important to us, and so is being transparent. Using beach equipment comes with inherent risks. By accepting these Terms and placing an Order, you are also agreeing to the full Liability Waiver.
- Assumption of Risk: You understand and acknowledge that beach activities and the use of the Equipment involve risks (e.g., injury, illness, or property damage) and you voluntarily assume those risks.
- Release of Liability: You release BeachDash and its team from any and all claims or liability arising from your use of the Equipment.
- Indemnification: You agree to indemnify and hold BeachDash harmless from any costs, damages, or legal fees arising from your use of the Service or breach of these Terms.
5. General Provisions
- Governing Law: These Terms are governed by the laws of the State of California.
- Changes to Terms: We may update these Terms from time to time and will provide notice of significant changes. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
